Public Records Request

Idaho House Bill 811, passed during the 2022 Legislative Session, amends the requirements for a Public Records Request.  Idaho Code 74-103(1) shall state the following:

All requests to examine public records shall be made to the designated custodian of such records as defined in section 74-101(3), IdahoCode. A public agency, a public official, or an employee of a public agency shall have no obligation and shall not be deemed to have assumed any obligation to respond to a public records request that fails to comply with the requirements of this subsection. A public records request must clearly indicate that it is a public records request.

 

To summarize, this text states that ALL PUBLIC RECORDS REQUESTS MUST BE MADE TO THE DESIGNATED CUSTODIAN AND CLEARLY IDENTIFIED IN ORDER TO BE CONSIDERED A PUBLIC REQUESTS REQUEST. In order to ensure that your Public Records Request is clearly identified, PLEASE COMPLETE THE ONLINE FORM PROVIDED BELOW.

 

After receiving your request, the custodian or the custodian’s delegate has three (3) working days to respond by granting or denying the request, or notifying the requester that more time is needed, up to seven (7) additional working days (or 10 working days from the date of receipt) to fulfill the request. If the custodian or custodian’s delegate does not respond within ten (10) working days from the date of receipt, the request is deemed denied.

 

Requests for information that is already published in the public domain of the City's website will be denied.

 

In accordance with Idaho Code 74-102(10)(a) Except for fees that are authorized or prescribed under other provisions of Idaho law, no fee shall be charged for the first two (2) hours of labor in responding to a request for public records, or for copying the first one hundred (100) pages of paper records that are requested.  In other words, the first 2 hours of labor and the first 100 pages are free to the public, however fees can be charged if the labor or copies exceed those amounts.
